This document contains the General Conditions of Contract (hereinafter “GCC”) governing the contractual relationship entered into between EKUORE and Customer when making a purchase through our Online Store Website (hereinafter “Virtual Store”).
These GCC have been drafted in compliance with applicable legislation on Electronic Contracting : Law 7/1996 of 15 January, of the Retail Trade; Law 3/2014, March 27th, General Law for the Protection of Consumers and Users; Royal Decree 1906/1999 of 17 December, on the Telephone and Electronic procurement is regulated; Law 7/1998 of 13 April, on General Conditions of Contract; and Law 34/2002 of July 11, services of the Information Society and Electronic Commerce.
The GCC are designed to regulate the set of business transactions arising between EKUORE and Customers of the Online Store.
The purchase of any products offered on the Virtual Shop constitutes acceptance as a Client, without reservations of any kind, each and every one of the terms and conditions described in these GCC.
EKUORE may at any time and without notice, amend these GCC, and define specific conditions that may alter the GCC that the Customer has accepted at time of purchase. Consequently, it is customer’s responsibility to read in depth, the responsibility of the Customer in each of the occasions when he makes a purchase through the Online Store.
If Customer does not agree with any terms or conditions set forth in the GCC, you should refrain from using the Virtual Store.
2. Improving the contractual relationship between the Customer and EKUORE
Pursuant to the provisions of the applicable regulations, the contractual relationship means perfect from the moment in which to complete the procedure established for this purpose, and once you read and accepted the GCC, the Client presses the button “BUY”.
The language proposed for improving the contractual relationship is Spanish, even when the website can be translated into multiple languages.
4. Marketed products
Through the Virtual Store EKUORE offers its customers the possibility to purchase any of the products displayed, depending on their interests, needs or tastes.
Within each category the Customer may find a description and photograph of the products available, so you can make an informed decision when making your purchase.
In EKUORE sell primarily related to medical devices with last smart technology and accesories.
To order or purchase through our Online Store you need to register as a user, by completing the electronic form, and following the instructions therein.
Upon registration, and to proceed with the purchase, Customer shall add the product you wish to purchase to cart, according to information provided at all times, filling in for this purpose the order form provided and validating it.
Prices and offers listed in the Virtual Store are valid exclusively for making purchases online, and may not represent current prices and other physical stores EKUORE.
The validation of the order by the client expressly assumes the knowledge and acceptance of the GCC as part of the Contract. Unless proven otherwise, constitute present proof of all transactions between EKUORE and their customers, so customers must provide true, current and valid for the formalization of this contractual relationship information.
EKUORE file the electronic document through which the contractual relationship is worded, and recommends the Customer also conserve, since it constitutes the essential evidence of the terms and conditions agreed at the time of purchase.
Once the purchase and in the shortest time possible, provided no later than 24 hours from the execution of the purchase, the Service Customer EKUORE will be sent by e- mail proof of purchase. If Customer does not agree with the data provided in the confirmation you can request the amendment thereof or if the cancellation of the contract for which available within 24 hours.
6. Availability of Products
Provided that the products are visible in the Virtual Store, means that they are available. On the website of each product within which we can issue it from our warehouse is indicated.
If the product selected by the Customer is in stock, the delivery time will be approximately 24-48 hours provided in the case of working days, according to Spanish calendar, and delivery is to be made in Peninsula. If delivery is requested outside Peninsula, contain in each case the delivery before the end of the purchasing process.
If instead you do not have stock, the product cannot be purchased at this time, however, the Customer may indicate that you want to be notified via email when the product is back in stock.
Delivery times are approximate. In some cases, even when our performance is completely diligent, may involve external factors (fortuitous event or force majeure) that could delay delivery processes.
As the delay in delivery the deadlines specified in unforeseeable circumstances or force majeure, or for reasons not attributable to EKUORE not entitle the Customer to demand compensation, unless the delay is due to the breach of the obligations under these GCC by EKUORE.
7. Form and shipping terms
Products purchased by Customer through our Virtual Store will be shipped to the shipping address that the customer has told us in the order. If the product selected by the Customer is in stock, the delivery time will be approximately 24-48 hours provided in the case of working days and delivery is to be made in Peninsula.
If delivery is requested outside Peninsula, contain in each case the delivery before the end of the process.
We offer various shipping methods to send you an order for a more comfortable, prompt and appropriate to your needs:
For shipping outside the Peninsula, the customer should pay the cost customs that the product generates, which will oscillate in function of the shipping´s weight. These costs will be paid when the customer received the product and in no case will be included in the price that it pays for the product.
The address indicated by the customer can be home address, work place or any other address that the customer has indicated. It is not necessary that coincide the Billing Address and Shipping Address.
8. Prices and Payments
All products offered through our Virtual Store have marked their prices in Euros and applicable taxes, in accordance with the interest rates applicable in each case and at all times.
For purchases in Spain will not be charged shipping Customer if delivery is to take place in Peninsula, except if the purchase is for less than 100€. Out of Spain shipping costs that apply are indicated in each case. Shipping costs will be displayed in each case the Customer before the end of the process.
Management fees are included in the price shown on each product, however, if the client requests that are delivered in special conditions, such as “gift-wrapped product,” additional management costs according to the circumstances be billed special requesting the Customer. In the latter case the cost of management will be indicated before the customer completes the purchase process.
EKUORE proposes different means of payment for Customer so that, he can choose the one that suits him/her or the one that best suits his/her needs:
- Payment by Credit Card / Debit Card
- Payment by bank transfer to account number that will be indicated to the customer in an email, for if it is selected this payment method
- Payment via PayPal system
Remember that EKUORE not proceed to send the purchased product, until it receives payment of the amounts described during the purchasing process. The indicated for the delivery period shall run from the time the payment is received.
9. Right of withdrawal
If the Customer is not satisfied with the products purchased, you may need to return them exercising the right of withdrawal assigned to the regulations.
The deadline for return is 15 days from receipt of order. The above- mentioned period shall run from receipt of the leased asset.
To exercise this right, the Customer must send your request to the following email address: info@eKuore.com and follow the step indicated by our Customer Service department. Circumstances that may cause the return of an order are:
- If the product you purchased the Customer does not satisfy you: You can always returned it is completed and in perfect condition. In this case the return or change for another product is permissible. The Customer shall bear the cost of returning and / or shipping the new product.
- Source defective product: the change will always be for the same item. In this case the customer does not bear the costs of returning the defective product or the new product to be sent to replace this.
10. Waiver of Liability
EKUORE is committed to always act fairly in good faith, in order to satisfy at all times the client’s needs. However in the following circumstances EKUORE is exempt from liability states:
- When the features and configurations of operating systems or computer screens Customer, are different, older or incompatible with those of EKUORE, causing it to disqualify some of the services provided through the Virtual Store, or is distorted or alter the appearance of the products purchased through the Online Store.
- When, despite security measures and the verification process implemented by EKUORE, buying is done by a child under 14 years of age.
- Where there is failure to provide services or deliver products purchased through the Virtual Store , if this is due to prolonged power outages, telecommunication lines, social conflicts, strikes, rebellion, explosions, floods, acts and omissions of the Government, and in general all cases of force majeure or unforeseeable circumstances.
11. Resolution of Disputes. Applicable law and jurisdiction
The GCC will be governed by Spanish law. Any dispute will be resolved in the courts of the domicile of EKUORE.
In the event that any provision of these GTC unenforceable or invalid under applicable law or pursuant to a judicial or administrative decision, such unenforceability or invalidity will not make these GTC unenforceable or invalid as a whole. In such cases, EKUORE shall amend or replace such provision with one that is valid and that, as far as possible, get the goal and intention reflected in the original provision.
12. Duration and Termination
GCC governing the contractual relationship between the Customer and signed EKUORE to make a purchase will apply to the purchase made and not the subsequent purchases that the Customer can carry on the website.
For this reason, the Customer must review and accept before each purchase, the current CGC at that time. However, EKUORE may terminate or suspend the validity of the contractual relationship in cases where the terms and conditions set forth in these GTC are breached. In such cases EKUORE announce the termination or suspension of the service given.

In case of discrepancy between English version and Spanish version of this CGC the Spanish one prevails.
If any provision of these conditions or any portion thereof becomes invalid or unenforceable, the remainder of these conditions shall not be affected and such provisions shall be valid and enforceable to the full at extent.
These CGC shall be governed by Spanish law. Disputes in conception with application of this CGC shall be resolved by Courts in Valencia (Spain)
